The owner of the site, 717 Media, LLC, a Michigan limited liability company (referred to herein as “HubScout" or HubScout.com), may unilaterally modify or terminate, at any time, any services offered by HubScout, with or without notice to you.

User Submitted Content to HubScout

The content submitted and displayed on HubScout.com (referred herein as “Submissions”) or content links on HubScout.com are developed by people over whom HubScout exercises no control. HubScout does not screen the content before it is displayed on the site.  We cannot guarantee that HubScout.com will not display unintended content on the site and HubScout assumes no responsibility or liability for the content of any User Submissions.

Any other use of this site is prohibited. By way of example, you should not use any features of this site that permit communications or postings to post, transmit, display, or otherwise communicate:

Without limiting the foregoing, under no circumstances shall HubScout or its licensors be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.

Indemnity

Ability to Accept Terms of Service

You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service.

Controlling Law, Jurisdiction and International Users

This Agreement is governed by and shall be construed in accordance with the laws of the State of Michigan, U.S.A., without reference to its conflicts of laws provisions. HubScout makes no representation that the materials are appropriate or available for use outside the United States. If you access this site from outside the United States, you will be responsible for compliance with all local laws. You agree to comply with all laws and regulations applicable to your use of this site. You agree to submit to the personal and exclusive jurisdiction of the state or federal courts located within Oakland County, Michigan for any disputes with HubScout arising out of your use of this site.

Entire Agreement

These Terms of Service constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, whether electronic, written or oral, regarding such subject matter. A printed version of these Terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. If for any reason a court of competent jurisdiction finds any provision of these Terms or portion thereof to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of these Terms, and the remainder of these Terms shall continue in full force and effect. Limitations on Claim

YOU AND HubScout AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THIS SITE AND/OR ANY SERVICES PROVIDED BY HubScout MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION SHALL BE PERMANENTLY BARRED.

Term and Termination

Without limiting its other remedies, HubScout may immediately discontinue, suspend, terminate, or block you and any other User’s access to this site at any time in our sole discretion.

Electronic Communications and Electronic Signatures

You agree to be bound by any affirmation, assent, or agreement you transmit through this site, including but not limited to, any consent you give to receive communications from HubScout solely through electronic transmission. You agree that when in the future you click on an “I agree, ”I consent,” or other similarly worded button or entry field with your mouse, keystroke, or other computer device, your agreement or consent will be legally binding and enforceable and the legal equivalent of your handwritten signature.
